These Terms of Service ("Terms") govern your use of subtlecandle.com and the products and services provided by 9 Inclined, LLC, doing business as Subtle Candle ("Subtle," "we," "us," or "our").

By accessing our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use our services.

1. Eligibility

By using our services, you represent that you have the legal capacity to enter into an agreement under applicable law.

If you use our services on behalf of another person or organization, you represent that you have authority to do so.

2. Our Online Store

Our store is hosted by Shopify.

Shopify provides the ecommerce platform through which we offer our products and services.

Certain features, payment methods, or services may also be subject to terms and policies provided by Shopify or other third parties.

3. Products and Fragrance

We make reasonable efforts to accurately describe and photograph Subtle products.

Because candles and fragrances have physical and sensory characteristics that may vary, we cannot guarantee that every product will appear or smell exactly as perceived through a screen or written description.

Natural or expected variations may occur in:

• Wax appearance

• Wax color

• Wax texture

• Vessel finish

• Other physical characteristics

Fragrance perception is subjective and may be affected by factors including:

• Room size

• Airflow

• Temperature

• Furnishings

• Individual fragrance sensitivity

• Environmental conditions

Descriptions of fragrance notes and scent experiences communicate the intended character of a fragrance but do not guarantee that every individual will perceive it in the same way.

4. Candle Safety

Candles contain an open flame and must be used responsibly.

Always follow the candle-care and safety instructions provided with your candle.

Never leave a burning candle unattended.

Keep candles away from:

• Children

• Pets

• Drafts

• Flammable materials

Place candles on stable, heat-resistant surfaces.

Do not touch or move a candle while the vessel or wax is hot.

Do not exceed the recommended burn time.

Discontinue use when the remaining wax reaches the minimum level specified in our candle-care instructions.

Improper use of candles can create a risk of fire, burns, property damage, or other injury.

5. Pricing

Prices are shown in the currency displayed on our website.

Prices may change without notice.

Applicable taxes, shipping charges, duties, or other amounts will be shown during checkout where appropriate.

We reserve the right to correct obvious pricing, product-description, promotional, or technical errors.

If an error affects an order you have already submitted, we may contact you before fulfillment or cancel the affected portion of the order and issue an applicable refund.

6. Orders

Submitting an order constitutes an offer to purchase the products included in that order.

We may accept, decline, limit, or cancel an order when reasonably necessary.

Reasons may include:

• Product availability

• Pricing errors

• Technical errors

• Suspected fraud

• Payment problems

• Shipping restrictions

• Purchase limits

• Suspected misuse of promotions

• Suspected unauthorized resale activity

If we cancel an order after collecting payment, we will issue an applicable refund.

An automated order confirmation acknowledges that we received your order but does not necessarily constitute final acceptance of the order.

7. Preorders

Certain Subtle products may be available for preorder.

Estimated shipping and availability dates are estimates unless expressly stated otherwise.

Production, transportation, inventory, fulfillment, or other circumstances may affect timing.

A preorder may be canceled for a full refund before it enters fulfillment.

Once a preorder enters fulfillment or ships, it can no longer be canceled and our standard Returns & Refunds Policy applies.

8. Payment

You agree to provide accurate and current payment, billing, and contact information.

You authorize us and our payment providers to charge the payment method you select for:

• Product cost

• Shipping charges

• Taxes

• Other applicable charges presented at checkout

9. Shipping

Subtle currently ships to the United States and Canada.

Shipping estimates are not guarantees.

Additional shipping terms are described in our Shipping Policy, which forms part of these Terms.

10. Returns and Refunds

Purchases are subject to our Returns & Refunds Policy.

Eligible unused and unburned products may be returned within 30 days of delivery, subject to the requirements described in that policy.

11. The Subtle Scent Guarantee

Qualifying candles may be covered by the Subtle Scent Guarantee.

If you try a fragrance and it is not right for you, you may contact us within 14 days of delivery for a qualifying one-time replacement in another fragrance or Subtle store credit.

Eligibility requirements and reasonable-use limitations are described in our Returns & Refunds Policy.

We reserve the right to limit claims involving suspected fraud, abuse, or misuse.

12. Promotions and Discount Codes

Promotional offers and discount codes may:

• Have expiration dates

• Apply only to selected products

• Require a minimum purchase

• Be limited to one use per customer or order

• Have geographic restrictions

• Be prohibited from being combined with other promotions

Unless expressly stated otherwise, promotional offers have no cash value.

We may modify or discontinue promotions as permitted by law.

13. Gift Cards

Subtle gift cards may be redeemed for eligible Subtle purchases.

Gift cards are not redeemable for cash except where required by applicable law.

Gift cards are final sale except where applicable law requires otherwise.

Additional terms may be presented when a gift card is purchased.

14. Customer Accounts

You may have the option to create or use a customer account.

You are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for activity conducted through your account.

Please contact us if you believe your account has been accessed without authorization.

15. Intellectual Property

The Subtle website and its contents are owned by or licensed to 9 Inclined, LLC and may be protected by copyright, trademark, trade-dress, patent, and other intellectual-property laws.

Protected materials may include:

• The Subtle name

• Logos

• Product names

• Fragrance names

• Vessel designs

• Packaging

• Photography

• Video

• Written content

• Graphics

• Illustrations

• Website design

• Other brand assets

You may use our website for personal, non-commercial purposes.

Except as permitted by law, you may not reproduce, distribute, modify, sell, commercially exploit, or create derivative works from Subtle intellectual property without authorization.

16. Reviews and User-Generated Content

You may have opportunities to submit:

• Ratings

• Reviews

• Photographs

• Videos

• Comments

• Testimonials

• Other content

You retain ownership of content you create.

By submitting content to Subtle, you grant 9 Inclined, LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, distribute, and otherwise use the content in connection with Subtle's business, products, website, social channels, advertising, and marketing, subject to applicable law.

You represent that you have the rights necessary to submit the content and grant this permission.

You may not knowingly submit content that:

• Infringes another person's rights

• Is unlawful

• Is fraudulent

• Is knowingly false or misleading

• Contains malicious software

• Contains private information you do not have authority to share

We may moderate or remove user-generated content where appropriate.

17. Prohibited Uses

You may not use our website or services to:

• Violate applicable law

• Commit fraud

• Infringe intellectual-property rights

• Harass or harm others

• Interfere with website operation or security

• Introduce malware or harmful code

• Attempt unauthorized access to systems or accounts

We may correct errors, inaccuracies, or omissions at any time.

20. Disclaimer

To the fullest extent permitted by applicable law, our website and online services are provided on an "as available" basis.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, 9 Inclined, LLC and its owners, officers, employees, affiliates, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of our website or services.

To the fullest extent permitted by law, our aggregate liability relating to a product purchase will not exceed the amount you paid to Subtle for the product giving rise to the claim.

Nothing in this section limits liability that cannot legally be limited or excluded.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold 9 Inclined, LLC harmless from claims, losses, liabilities, damages, and reasonable costs resulting from:

• Your unlawful misuse of our services

• Your material violation of these Terms

• Your infringement of another party's rights

24. Electronic Communications

When you provide an email address or telephone number, we may send transactional communications relating to:

• Accounts

• Customer service

• Shipping

• Refunds

Marketing communications are subject to the consent and opt-out mechanisms provided at enrollment and described in our Privacy Policy.
